Effective from 19 October 2026. This is an English translation of the Polish Regulamin serwisu; in case of discrepancies, the Polish version prevails.
1. General provisions
These Terms set out the rules for using the website prosm.pl (the “Website”) and the services provided on it electronically. They are the terms of service required by Article 8 of the Polish Act of 18 July 2002 on providing services by electronic means.
The service provider is Wojciech Oleszko, running a business as Wojciech Oleszko Creative Team (brand PROSM), ul. Kminkowa 43/18, 51-180 Wrocław, Poland, VAT/NIP: PL8951808958, REGON: 021403397, e-mail: kontakt@prosm.pl, phone: +48 509 052 773 (the “Provider”).
These Terms do not cover paid services. Websites, local SEO, Google Business Profile management, video and the local visibility subscription are ordered individually — their scope, price and conditions are set out in the offer and the contract.
2. Services provided electronically
Free of charge, the Provider offers on the Website:
- browsing content — services, case studies, articles;
- contact forms — sending an enquiry to the Provider;
- chat with an automated assistant answering questions about the services;
- cookie settings — choosing consents in the banner and via the “Cookie settings” link in the footer.
3. Conclusion and termination
- The agreement for browsing and for using the chat is concluded when you open the Website or start a conversation, and ends when you leave the Website or close the chat.
- The agreement for using a form is concluded when you start filling it in, and ends when you send or abandon it.
- All services listed in section 2 are free of charge.
4. Technical requirements
A device with internet access and an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge) with JavaScript enabled.
5. Rules of use
- Providing unlawful content, including content infringing third-party rights, is prohibited.
- Actions disrupting the Website are prohibited: spam, automated form submissions, attempts to bypass security and bulk downloading of content.
- Please provide true contact details in forms. Do not share passwords, access data or sensitive data (e.g. health data) in the chat.
- In case of abuse, the Provider may limit or block messages sent from a given device.
6. Chat assistant
- The assistant replies automatically using a language model — it is not a human.
- Its answers are for information only and may contain errors. They are not an offer within the meaning of Article 66 of the Polish Civil Code or a binding commitment of the Provider. Only an offer sent by the Provider and a signed contract are binding.
- The assistant does not conclude contracts or accept orders.
7. Website content
- Website content (texts, graphics, photos, videos, code, logo) is protected by copyright. Using it beyond permitted use requires the Provider’s consent.
- Prices and service descriptions on the Website are commercial information and an invitation to talk, not an offer within the meaning of the Civil Code. Articles are for information only.
8. Risks of using the internet
Using the internet involves typical risks such as malware, phishing, spam and interception of data by third parties. The Website uses an encrypted connection (HTTPS). The Provider never asks for passwords or payment card details by e-mail, phone or chat — online payments take place only on the page of the payment operator Stripe. We recommend keeping your operating system and browser up to date and being careful with links and attachments from unknown sources.
9. Personal data and cookies
How personal data and cookies are handled is described in the Privacy policy. You can change your cookie consents at any time via the “Cookie settings” link in the footer.
10. Complaints
- Complaints about the services listed in section 2 can be sent to kontakt@prosm.pl with a description of the problem and a reply address. The Provider replies within 14 days.
- Consumers may use out-of-court complaint and redress procedures, e.g. the free assistance of a local consumer ombudsman (rzecznik konsumentów) in Poland. Information: prawakonsumenta.uokik.gov.pl.
11. Availability
The Provider takes care that the Website works without interruption, but may temporarily suspend it or selected features (e.g. the chat) for maintenance or in case of failures on the side of service providers.
12. Final provisions
- The Provider may change these Terms for important reasons, in particular changes in the law, new services or changes in how they are provided. The new version is published on the Website.
- Polish law applies to matters not covered by these Terms. This choice of law does not deprive a consumer of the protection granted by the law of their country of habitual residence.
- These Terms are effective from 19 October 2026.
